Terms & Conditions for Punctual Transport Management Corp
DEFINITIONS
In these Terms and Conditions, the following terms shall have the meanings set forth below:
a. “Punctual Transport Management Corp.” (“PTMC”, “Company”, “we”, “us”, or “our”) refers to Punctual Transport Management Corp., located at 78 Route 59, Monsey, New York 10952.
b. “Customer” (“you” or “your”) refers to the individual or entity booking or using the coach bus charter and bus rental services provided by PTMC.
c. “Services” refers to the coach bus charter and bus rental services provided by PTMC.
d. “Agreement” refers to the contract entered into between PTMC and the Customer for the provision of Services, which is governed by these Terms and Conditions.
RATES AND PAYMENT TERMS
a. PTMC reserves the right to modify the advertised rates without prior notice and at any time before confirming your reservation.
b. The estimated rate for the Coach Bus Charter Services is based on the information provided by you during the reservation process. Additional charges may apply for taxes, credit card processing fees, damages to the buses, driver injuries, overtime, additional stops, and excessive cleaning. The fee for excessive cleaning will be determined by PTMC, with a minimum fee of $250.
c. By making a reservation, you authorize PTMC to process payments through your provided check/savings account or credit card. If your financial institution declines a large transaction, PTMC may attempt multiple smaller transactions. Declined credit/debit card payments may lead to termination of credit/debit card payment options, with the remaining balance payable by check or wire transfer.
d. Payments exceeding $5,000 may require payment via check or wire transfer, unless otherwise agreed upon in writing. Refusal to pay via check or wire transfer does not negate the agreement, and cancellation charges will still apply.
e. You agree not to dispute fees or charges in accordance with this agreement, including cancellation fees and dispute resolution. Disputing such fees may lead to additional charges for related fees, attorney expenses, and court or arbitration costs.
CHARTER SERVICES
a. Vehicle images and information presented on PTMC’s website may vary from the actual vehicles provided.
b. PTMC does not guarantee specific vehicle features, including make, model, year, appearance, heating, air conditioning, plumbing functionality, driver behavior, or provision of amenities due to weather, mechanical issues, or other events beyond control.
c. PTMC is not responsible for vehicle delays due to Force Majeure events, GPS malfunctions, signal problems, route inaccuracies, road closures, or traffic delays. The driver’s discretion in travel decisions is acknowledged.
d. Special permit or certificate-required vehicles may not be provided unless arranged in writing at reservation time.
e. A reasonable number of seats may be reserved for additional drivers or support staff.
f. Lost or damaged items are not PTMC’s responsibility, and retrieval may incur a fee.
g. PTMC may terminate trips if passengers jeopardize safety or possess illegal materials. No refund will be issued in such cases.
LICENSE
You grant PTMC a perpetual, royalty-free license to use your trade names, trademarks, or service marks in connection with events. If PTMC reserves services for third-party events, you agree to obtain a license for third-party trademarks.
CANCELLATION AND REFUND POLICY
Cancellation fees are as follows:
- Over 30 days prior to service: Full deposit refund.
- Between 15 and 30 days: 50% deposit refund.
- Less than 15 days: No refund.
PTMC reserves the right to cancel due to unforeseen circumstances, providing alternatives or refunds.
CUSTOMER RESPONSIBILITIES
Provide accurate information, ensure passenger compliance with laws and policies, and compensate for damage caused during service.
LIABILITY
PTMC is not liable for personal injury, loss, or damage unless caused by negligence or willful misconduct. Damages are limited to the amount paid for services.
FORCE MAJEURE
PTMC is not liable for service delays or failures due to uncontrollable events.
GOVERNING LAW AND JURISDICTION
New York law governs this agreement, and disputes are subject to the exclusive jurisdiction of New York courts.
SEVERABILITY
Invalid provisions are severed, with remaining terms upheld.
ENTIRE AGREEMENT
These Terms and Conditions constitute the entire agreement, superseding all prior understandings.
AMENDMENT
PTMC may amend these terms without notice. Continued service use implies acceptance.
